Samsung ready to counter Apple’s infringement claims, says “there can be no iPhone without our patents”


Samsung has drawn a line in the sand, and says it will not concede to licensing Apple’s wireless and UI patents like its competitor HTC. According to Korea Times, Samsung’s CEO JK Shin said, “without Samsung-owned wireless patents, it’s impossible for the Cupertino-based Apple to produce its handsets. As you know, Samsung is very strong in terms of portfolios of wireless patents.”

This comes after Samsung lost a patent infringement case to Apple in a California Court earlier this year, requiring the Korean company to pay over $1 billion in damages. The two companies are set to continue their fight as Samsung recently appealed to the U.S. International Trade Commission to review a ruling that stated Apple didn’t infringe on four of Samsung’s wireless patents under the FRAND (fair, reasonable and non-discriminatory) patent standards. Samsung also failed to convince a jury during this summer’s trial that Apple infringed on its patents. The ITC panel is expected to give its final decision on the matter in January.

Samsung’s troubles with Apple appear not to be impeding its plans to introduce new handsets. According to Korea Times, the company has plans to introduce the Galaxy S IV in February at Mobile World Congress, only nine months after it introduced the Galaxy S III.
